Frequently Asked Questions

1. How do the new Notary Regulations affect me?

The New Mississippi Notary Public Regulations may be viewed at http://www.sos.state.ms.us/busserv/notaries/New%20Notary%20Forms/NOTARY%20Rule.pdfPerhaps the most significant item affecting day to day Notary function is the requirement that an Ink Impression Seal Stamp be used instead of an Embosser(crimps the paper).  This requirement applies to Notary applications, new or renewal, submitted on, or after July 1, 2007.  If you applied prior to that date, you need NOT change until you renew.

2. What are the requirements to be a Notary Public in Mississippi?

There is no test. Qualifications are listed in section 102 of the Mississippi Notary Rules and Regulations (see FAQ #1 for link)  You must apply with the Secretary of State ($25 fee), file a $5000 Surety Bond once approved, and obtain an official Seal or Stamp to affix to acknowledgements. As a Notary Public, you must comply with the Statutes of Mississippi for Notarial acts. You may download all the necessary forms here.

3. How much does it cost to become a Notary Public in Mississippi?

Our Basic New Notary Kit is $100.00. The cost can vary, depending on the supplies ordered.

4. How long does the process take?

Around 7 working days.

5. What about renewing a commission that is about to expire? What must I do?

The process is the same as a new commission. You must apply and file a new bond.

6. Must I fill out the Bond form as well as the application?

You must only complete the signature requirements(2). Sign as Principal(X), and sign the Oath of Office(X) in front of another Notary and get their acknowledgement where indicated. We will complete the official information, file the completed and executed bond with the Sec. of State, and send you a copy of the completed bond.

7. Must I go to the Circuit Clerk's Office?

No, this step is no longer required by the Secretary of State.

8. Do you accept credit cards or purchase orders?

Yes, we accept MasterCard and Visa credit cards and Company and Government P.O.s. For credit cards, simply write the card # and exp. date on the order form, or ask us to call for the account number.

9. I have moved my residence, what must be done?

You must complete a Change of Address form.  This form is available at the Sec. of State's website, http://www.sos.state.ms.us/forms/forms.asp?TextOnly=NO&Unit=Notary%20Public to print. Once the name change is effected at the Sec. of State, a new seal stamp should be ordered, if your residence County has changed, using the order form available here.

10. My name has changed since my Notary Commission began, What must I do?

You must complete a Change of Name  form.  This form is available at the Sec. of State's website, http://www.sos.state.ms.us/forms/forms.asp?TextOnly=NO&Unit=Notary%20Public  to print. Once the name change is effected at the Sec. of State, a new seal stamp should be ordered, if your residence County has changed, using the order form available here.

11. I live in one County, and work in a different County. Can I notarize at work?

Your Notary Public Commission has Statewide Authority. You can notarize in any county within Mississippi, but your seal must show your residence county.

12. Can I notarize my own signature?

No.

13. Can I notarize the signature of a family member, spouse, or relative?
